Romanian Parliament to debate lobby law on Monday

The agenda of the juridical committee within the Chamber of Deputies includes on Monday a debate around two draft laws on lobby activities. One of them was also debated in December 2013.

The project, initiated by former Social Democratic Party (PSD) Constantin Nita, was rejected by the Senate the same year, and the plenum 10 December 2013 was resent to the committees. At the time, all parties agreed that the law was a necessary one and took on the commitment to adopt it on 1 February 2014. However, the project did not materialize and the project was roadblocked by the Juridical Committee.

Both the Dacian Ciolos Government, on 13 April 2016, as well as the current government, 4 April 2017, issued a negative opinion on this draft law.

In 2010, PSD MP Constantin Nita, former Minister of Energy, submitted a draft law project on the regulation of lobby activities. The draft law defines the term of ‘professional lobbyist” as the person which, as an employee of a client and in return for material compensation or of other nature, is performing services that involve more than a lobby-type communication, but not that person whose lobby activities represent less than 20 percent of the services provided to the client within a period of six months.

The draft law also forbids MPs, government members and public administration employees, agencies of other state bodies, as well as companies where the state holds a participation that is higher than 51 percent. Political parties and people who are part of the management are also prevented from lobbying.
